يندرج القانون التنظيمي المتعلق بالجهات في إطار تفعيل مقتضيات دستور المملكة المغربية، ولا سيما الفصل 146 منه الذي ينص على أنه ” تحدد بقانون تنظيمي بصفة خاصة:
-شروط تدبير الجهات والجماعات الترابية الأخرى لشؤونها بكيفية ديمقراطية، وعدد أعضاء مجالسها والقواعد المتعلقة بأهلية الترشيح …”
هذا، والجدير بالذكر أن البرنامج الحكومي الذي عرض أمام البرلمان بتاريخ 19 يناير 2012 ، سبق وأن التزم بإصدار هذا القانون التنظيمي وفقا لمقتضيات الدستور.
ويسعى هذا القانون إلى تكريس وتجسيد نهج الجهوية الموسعة التي اختارها المغرب كنمط جديد للحكامة الترابية الرامية إلى إصلاح وتحديث هياكل الدولة وفق مقاربة تشاركية مندمجة مبنية على مبادىء التوازن والتضامن الوطني والجهوي وفي احترام تام لوحدة الدولة والوطن والتراب.
سنحاول من خلال هذا المقال التطرق إلى المبادىءالمؤطرة للتنظيم الجهوي المضمنة بالدستور:
• المضامين الأساسية للقانون التنظيمي للجهة:
-المبادىء الأساسية المعتمدة؛
-المقتضيات المتعلقة بتنظيم المجالس وتسييرها؛
-النظام الأساسي للمنتخب؛
-اختصاصات الجهة؛
-صلاحيات المجلس ورئيسه؛
-النظام المالي للجهات؛
-الإدارة وأجهزة تنفيذ المشاريع؛
-المقتضيات المتعلقة بالمراقبة الإدارية؛
-المقتضيات المتعلقة بالمنازعات؛
-المقتضيات المتعلقة بقواعد الحكامة الجيدة.
