Masalah Ta’abbudiy

Rasanya tidak mnejadi perselisihan di antara ulama bahwa masalah waris atau Faraidh adalah masalah ta’abbudiy dalam agama; alias masalah ritual yang sedikit sekali peluang ijtihad di dalamnya.

Sebabnya karena memang Allah s.w.t. sudah menetapkan jatah masing-masing ahli waris dengan nilai yang sudah ditentukan melalui wahyu. Maka tak perlu repot-repot berijithad soal berapa jatah ibu atau berapa jatah istri; Allah s.w.t. sudah jelaskan.

Bahkan bukan hanya jatah berapa yang ditentukan, tapi siapa saja yang mendapat jatah pun dijelaskan dengan detail. Itu dijelaskan secara rinci dalam surat al-Nisa’ 11 sampai 13 tersebut, dan juga di penghujung surat al-Nisa’ yakni ayat 176; tentang kallalah (seseorang yang wafat tanpa meninggalkan anak).

Itu dia kenapa ilmu ini disebut dengan istilah Faraidh [فرائض ]; karena Faraidh itu sendiri adalah kata plular atau jamak’ dari kata mufrad atau single Faridhah [فر ضٌة ] yang akar katanya berasal dari kata Fardh [فرض ] yang artinya adalah tetap atau pasti.
