Rasulullah saw melarang seseorang duduk diatas kuburan di beberapa haditsnya, diantaranya sabda Rasulullah saw,”Sesungguhnya seorang dari kalian yang duduk ditas bara api lalu membakar pakaian hingga menyisakan kulitnya lebih baik baginya daripada duduk diatas sebuah kuburan.” (HR. Muslim didalam “Shahih” nya)

Sabdanya saw yang lain,”Sesungguhnya aku berjalan diatas bara api atau pedang atau aku menambal sandal dengan kakiku lebih aku sukai daripada berjalan diatas sebuah kuburan muslim.” (HR. Ibnu Majah, dishahihkan oleh al Bushairiy dan sanadnya baik menurut al Albani)

Sabdanya saw yang lain,”Janganlah kalian duduk diatas kuburan dan janganlah shalat menghadapnya.” (HR. Muslim)

Dari beberapa dalil diatas, para ulama madzhab Hanafi, Syafi’i, Hambali dan Zhahiriy berpendapat bahwa hal itu adalah makruh. Sementara Nawawi di dalam “al Majmu” mengatakan,”Makruh duduk diatas kuburan, bersandar dengannya dan kami pernah menyebutkan bahwa hal itu adalah makruh menurut kami (madzhab Syafi’i), demikian pula menurut jumhur ulama.”
