على المسبوق أن يحرم فورا ويدخل مع الإمام كيفما وجده ، قائما أو راكعا أو ساجد أو جالسا ، فإن وجده قائما أو جالسا كبر تكبيرة الإحرام فقط ، وإن وجده راكعا أو ساجدا كبر تكبيرة الإحرام قائما ثم كبر تكبيرة
أخري ينحني بها للركوع أو السجود . ثم إذا سلم الإمام قام المسبوق قاضيا لأقواله بانيا في أفعاله :

جاء في شرح الخرشي لمختصر خليل :" أَنَّ الْمَسْبُوقَ إذَا أَدْرَكَ بَعْضَ صَلَاةِ الْإِمَامِ ، وَقَامَ لِإِكْمَالِ مَا بَقِيَ مِنْ صَلَاتِهِ بَعْدَ سَلَامِ الْإِمَامِ ، فَإِنَّهُ يَكُونُ قَاضِيًا فِي الْأَقْوَالِ بَانِيًا فِي الْأَفْعَالِ، وَالْقَضَاءُ عِبَارَةٌ عَنْ جَعْلِ مَا فَاتَهُ قَبْلَ الدُّخُولِ مَعَ الْإِمَامِ أَوَّلَ صَلَاتِهِ ، وَمَا أَدْرَكَهُ آخِرَ صَلَاتِهِ، وَالْبِنَاءُ عِبَارَةٌ عَنْ جَعْلِ مَا أَدْرَكَهُ مَعَهُ أَوَّلَ صَلَاتِهِ ، وَمَا فَاتَهُ آخِرَ صَلَاتِهِ ..... وَالْمُرَادُ بِالْأَقْوَالِ الْقِرَاءَةُ خَاصَّةً ، وَأَمَّا غَيْرُهَا مِنْ الْأَقْوَالِ فَهُوَ بَانٍ فِيهِ كَالْأَفْعَالِ ...
